These general terms and conditions apply to all agreements between ERIKS and its customers, as well as to all quotations and orders issued by customers to the exclusion of any terms and conditions of the customer. ERIKS is only bound by deviations in the applicability of these general terms and conditions and of the general terms and conditions themselves after they have been confirmed by ERIKS in writing to the customer. At the time of the conclusion of the agreement, the customer is deemed to have agreed to the exclusive applicability of these general terms and conditions; the same applies to any subsequent orders placed by the customer, either verbally, by telephone or facsimile or in any other way whatsoever, rendering a written confirmation from ERIKS superfluous.
